Our purpose is to describe the application of legitimate defense in so-called non-confrontational situations. To do this, we will conceptualize gender violence as that which against women, due to their condition as such, and we will describe the absence by the courts in the identification of this problem. Second, we will analyze the reception of Argentine and international legislation on the treatment of gender violence and the recommendations and criteria to take into account when interpreting and applying criminal law. Finally, (...) we will present the treatment of legitimate defense in contexts of gender violence, analyzing each of its elements. Our conclusions will focus on the need to address situations of gender violence based on international regulations for the application of legitimate defense in non-confrontational situations. To verify the occurrence of a singular instance of testimonial injustice three facts must be established. The first is whether the hearer in fact has an identity prejudice of which she may or may not be aware; the second is whether that prejudice was in fact the cause of the unjustified credibility deficit; and the third is whether there was in fact a credibility deficit in the testimonial exchange. These three elements constitute the facts of the matter of testimonial injustice. (...) In this essay we argue that none of these facts can be established with any degree of confidence, and therefore that testimonial injustice is an undetectable phenomenon in singular instances. Our intention is not to undermine the idea of testimonial injustice, but rather to set limits to what can be justifiably asserted about it. According to our argument, although there are insufficient reasons to identify individual acts of testimonial injustice, it is possible to recognize recurrent patterns of epistemic responses to speakers who belong to specific social groups. General testimonial injustice can thus be characterized as a behavioral tendency of a prejudiced hearer. (shrink)

En este ensayo intentaremos realizar una pequeña aproximación al pensamiento de Gilbert Simondon, filósofo francés cuya obra podría resumirse en sus dos tesis doctorales defendidas en 1958, una de las cuales no fue publicada de forma completa sino póstumamente. No obstante, lo dicho, tras el creciente interés en su pensamiento comenzaron a publicarse ya nacido este milenio, en particular en Argentina, sus cursos sobre percepción, imaginación, invención, información, comunicación y tecnología. A pesar de su escueta obra, Simondon es un filósofo (...) de sistema, que a partir de su teoría de la individuación intentó fundar un monismo ontogenético en el cual puedan entrar en comunicación todas las disciplinas humanas; y para ello buscó explotar todos los recursos conceptuales que brindaron las revoluciones científicas de su época. En este ensayo, sin embargo, abordaremos tan sólo el tipo de realidad o estatus ontológico que Simondon atribuía a los objetos técnicos. Para ello desarrollaremos 4 apartados y un bis. En el primero, haremos un esbozo de lo que es el método filosófico propuesto por Simondon, el cual describimos como un paradigmatismo analógico. En el segundo, desarrollaremos algunas críticas a cierto paradigmatismo particular que, según Simondon, subyace en gran parte del pensamiento occidental y que nos impide, entre otras cosas, comprender la realidad propia de los OT, a saber: el hilemorfismo. En tercer lugar, analizaremos en qué medida podemos salvar la realidad de los OT de ser reducida a mero constructo social. En cuarto lugar; analizaremos algunas analogías y disparidades entre los OT y los seres vivientes. Por último, a modo de apéndice, expondremos sucintamente un artículo de Esperanza García y Villegas Jaraleño, presentado en el último volumen de Scientia in verba, en el cual se plantea la pregunta sobre el estatus ontológico de los artefactos biotecnológicos desde una perspectiva bungeana; así como pequeñas críticas y aportes que pudiésemos hacerle desde el pensamiento simondoniano. This article shows a selection of Catullus’ homoerotic texts and their translations. Thus, we analyze and introduce part of the Catullus’ sexual source culture, which differs from the current homosexual target culture in order to make these texts and the knowledge therein contained available to the Latin American audience. Our aim is to produce these translations analyzing varied, complex, and vague lexical sources, the differences between the source and target cultures, and other factors that challenge the translator in the realization (...) of his work. Resumen: Una de las formas más comunes y menos estudiadas de parcialidad judicial subjetiva es la disminución de la credibilidad otorgada a un testigo debido a un prejuicio identitario implícito del agente judicial. En la epistemología social, este fenómeno ha sido estudiado bajo la rúbrica de la injusticia testimonial. En este ensayo mostramos que para determinar la ocurrencia de un caso de injusticia testimonial en el derecho se deben cumplir tres condiciones que son imposibles de verificar empíricamente y que están (...) basadas en presupuestos psicológicos que han sido puestos en duda en años recientes. Sin la posibilidad de verificar estas condiciones, estamos frente a un tipo de parcialidad judicial indetectable. En su lugar, ofrecemos una nueva forma de entender la injusticia testimonial en el derecho como un fenómeno más general que describe una tendencia comportamental prejuiciosa recurrente por parte de un agente judicial. Entendida de este modo, la injusticia testimonial es completamente verificable. -/- Abstract: One of the most common and least studied forms of subjective judicial partiality is the credibility deficit suffered by a witness due to an implicit identity prejudice in a judicial agent. Social epistemologists have studied this form of partiality under the rubric, “testimonial injustice.” In this essay we argue that to verify the occurrence of a singular instance of testimonial injustice in law three facts must be established, none of which can be established with any degree of confidence. Furthermore, all of them are based on psychological suppositions that have been recently discredited. Without the possibility of establishing these facts, we end up with an undetectable form of subjective judicial partiality. In its place, we offer a new way of understanding testimonial injustice in law as a general phenomenon that describes a recurrent pattern of prejudiced behavior in a judicial agent. John Stuart Mill fue un reformador social. Como gran parte de los pensadores del siglo XIX, creía en la idea de progreso. Consideraba que se estaba viviendo un tiempo de transición, en el que se daba una tendencia hacia un mejor y más feliz estado de cosas, aunque también percibía que la época era de riegos y amenazas. No se pensaba ni como filósofo ni como académico ni como político, se veía a sí mismo como un reformador social, cuya función (...) era educar a la opinión ilustrada y progresista. El propósito de sus textos es persuadir y, con ello, ayudar a transformar. Sus tesis defienden la necesidad de organizar la sociedad moderna bajo ciertos principios para que pueda alcanzar un estado superior de progreso social y moral. -/- Contra la acusación de que John Stuart Mill es un pensador ecléctico, contradictorio y que no añade nada a los clásicos, el libro que el lector tiene en sus manos muestra que su originalidad no consistió en haber creado nuevos conceptos, sino en haber transformado conceptos fundamentales de la filosofía social, moral y política, matizándolos, otorgándoles nuevos sentidos y abriéndoles nuevas posibilidades. Fue un utilitarista, pero la doctrina utilitarista salió renovada de sus escritos. Fue un liberal, pero en un sentido nuevo de liberal, ni clásico ni contractualista. Fue demócrata, aunque en un sentido distinto del de la voluntad general de Rousseau. Fue socialista, pero un socialista cualificado. -/- Como educador de la opinión ilustrada, tuvo un éxito extraordinario. Sus libros tuvieron una gran acogida y su nombre gozó de prestigio, admiración y respeto en Inglaterra. El contenido de la obra se halla dividido en dos partes, una primera teórica y otra segunda práctica. En la primera parte se realiza una explicación analítica del ciberactivismo mientras que la segunda se centra en reflexiones sobre aspectos concretos que pudieran ser útiles para quien desee planificar alguna acción.

En el presente trabajo se parte de que la innovación requiere transmisión de información. En la actualidad, el contenido de la transmisión de información se halla sometido a una regulación legal, habitualmente la propiedad intelectual, donde los agentes intervinientes y su requisito de sistema de permisos dificultan la transmisión libre. Para solucionar esta problemática, se están promoviendo dos tipos de soluciones: el primero mediante código legal y el segundo mediante código informático. This article tries to establish the scopes and limits of the main interpretations on Newton during the 20th century, highlighting on the one hand the textual evidence at disposal, and on the other hand the philosophical and epistemological currents that defines the main features of those interpretations. It will be shown that the rejection of positivism is not sufficient condition for establishing an adequate interpretation and, together with the strengthening of the research from Newton’s manuscript, it is necessary a wider, (...) and more detailed model that those established by some of the most outstanding scholars like Alexandre Koyré, I. Este artículo de reflexión problematiza la didáctica de las lenguas extranjeras desde una inquietud filosófica-intercultural para contextos mayoritaria e históricamente monolingües como el latinoamericano. Inicialmente, se describen los rasgos de colonialidad latentes en el enfoque que el Marco Común Europeo de Referencia asume para tratar la interculturalidad. Seguidamente, se realiza un análisis crítico-filosófico de los desafíos que la interculturalidad enfrenta en América Latina en el contexto anteriormente mencionado, y se revisan las relaciones que existen entre interculturalidad y glotopolítica, asumiendo que (...) el latinoamericanismo de Mendieta, la resemantización del orientalismo de Said, el mimetismo y la hibridación bhabhiana, así como la filosofía intercultural, son quizá los desafíos filosóficos más grandes. Finalmente, se presenta un exordio para una interculturalidad crítica en lenguas-culturas extranjeras, en el que se tienen en cuenta algunas contribuciones del Grupo Modernidad/Colonialidad, concretamente de Dussel, Walsh, Castro-Gómez y Fornet-Betancourt, reconociendo que la didáctización de la interculturalidad en las licenciaturas de lenguas modernas de Colombia está por construirse. According to theoretical work on epistemic injustice, baseless discrediting of the knowledge of people with marginalized social identities is a central driver of prejudice and discrimination. Discrediting of knowledge may sometimes be subtle, but it is pernicious, inducing chronic stress and coping strategies such as emotional avoidance. In this research, we sought to deepen the understanding of epistemic injustice’s impact by examining emotional responses to being discredited and assessing if marginalized social group membership predicts these responses. We conducted a novel (...) series of three experiments (Total N = 1690) in which participants (1) shared their factual knowledge about how a game worked or their personal feelings about the game; (2) received discrediting feedback (invalidating remarks), validating feedback (affirming remarks), or insulting feedback (general negative social evaluation); and then (3) reported their affect. In all three studies, on average, affective responses to discrediting feedback were less negative than to insulting feedback, and more negative than to validating feedback. Participants who shared their knowledge reported more negative affect after discrediting feedback than participants who shared their feelings. There were consistent individual differences, including a twice-replicated finding of reduced negative affect after receiving discrediting and insulting feedback for Black men compared to White men and women and Black women. Black men’s race-based traumatic symptom scores predicted their affective responses to discrediting and insulting feedback, suggesting that experience with discrimination contributed to the emotional processing of a key aspect of epistemic injustice: remarks conveying baseless discrediting of knowledge. As COVID-19 emerged as a phenomenon of the total environment, and despite the intertwined and complex relationships that make humanity an organic part of the Bio- and Geospheres, the majority of our responses to it have been corrective in character, with few or no consideration for unintended consequences which bring about further vulnerability to unanticipated global events. Tackling COVID-19 entails a systemic and precautionary approach to human-nature relations, which we frame as regaining diversity in the Geo-, Bio-, and Anthropospheres. Its (...) implementation requires nothing short of an overhaul in the way we interact with and build knowledge from natural and social environments. Hence, we discuss the urgency of shifting from current to precautionary approaches to COVID-19 and look, through the lens of diversity, at the anticipated benefits in four systems crucially affecting and affected by the pandemic: health, land, knowledge and innovation. Our reflections offer a glimpse of the sort of changes needed, from pursuing planetary health and creating more harmonious forms of land use to providing a multi-level platform for other ways of knowing/understanding and turning innovation into a source of global public goods. These exemplary initiatives introduce and solidify systemic thinking in policymaking and move priorities from reaction-based strategies to precautionary frameworks. (shrink)

Abstract In this essay, I will argue that images can play a substantial role in argumentation: exploiting information from the context, they can contribute directly and substantially to the communication of the propositions that play the roles of premises and conclusion. Furthermore, they can achieve this directly, i.e. without the need of verbalization. Empiezo con algunos comentarios famosos del filósofo (psicólogo) Ludwig Wittgenstein porque Pinker comparte con la mayoría de la gente (debido a la configuración predeterminada de nuestra psicología innata evolucionada) ciertos prejuicios sobre el funcionamiento de la mente, y porque Wittgenstein ofrece una visión única y profunda del funcionamiento del lenguaje, el pensamiento y la realidad (que él consideraba más o menos coextenso) que no se encontraba en ningún otro lugar. Ahí esta sólo referencia a Wittgenstein en este volumen, lo que (...) es más desafortunado teniendo en cuenta que él era el analista más brillante y original del lenguaje. -/- En el último capítulo, usando la famosa metáfora de la cueva de Platón, resume bellamente el libro con una visión general de cómo la mente (lenguaje, pensamiento, psicología intencional)-un producto de egoísmo ciego, moderado sólo ligeramente por el altruismo automatizado para cerca parientes que llevan copias de nuestros genes (Fitness inclusivo)--funciona automáticamente, pero trata de terminar en una nota optimista al darnos la esperanza de que, sin embargo, podemos emplear sus vastas capacidades para cooperar y hacer del mundo un lugar digno para vivir. -/- Pinker es ciertamente consciente de, pero dice poco sobre el hecho de que mucho más sobre nuestra psicología se deja fuera de lo incluido. Entre las ventanas a la naturaleza humana que se dejan fuera o se presta una atención mínima son las matemáticas y la geometría, la música y los sonidos, las imágenes, los eventos y la causalidad, la ontología (clases de cosas o lo que sabemos), la mayor parte de la epistemología (cómo sabemos), disposiciones (creer, pensar, juzgar, pretender, etc.) y el resto de la psicología intencional de la acción, neurotransmisores y entheogens, Estados espirituales (por ejemplo, Satori e iluminación, estimulación y grabación del cerebro, daño cerebral y comportamiento déficits y trastornos, juegos y deportes, teoría de la decisión (incluyendo la teoría del juego y la economía conductual), comportamiento animal (muy poco lenguaje pero mil millones de años de genética compartida). Se han escrito muchos libros sobre cada una de estas áreas de la psicología intencional. Los datos de este libro son descripciones, no explicaciones que muestran por qué nuestro cerebro lo hace de esta manera o cómo se hace. ¿Cómo sabemos usar las oraciones de manera diversa (es decir, conocer todos sus significados)? Esta es la psicología evolutiva que opera a un nivel más básico: el nivel en el que Wittgenstein es más activo. A raíz de la traducción que hace el profesor José Manuel Romero Cuevas de los escritos del joven Marcuse, esta reseña se centra en dos de estos inéditos del autor alemán: Nuevas fuentes para la fundamentación del materialismo histórico (1932) y Sobre los fundamentos filosóficos del concepto científico-económico de trabajo (1933). Este volumen entrega, además, un intercambio epistolar entre Marcuse y Heidegger en el que se advierten, gracias a la traducción de Romero, no únicamente las intenciones filosóficas y políticas (...) de Marcuse sino también sus puntos de encuentro y desencuentro con respecto a Heidegger. Este norte se traza debido a las preocupaciones del pensador de Frankfurt por constituir una filosofía concreta, es decir, la reflexión radical del mundo que afirma la posibilidad de su transformación. En este punto la reseña hace referencia a las diferentes posturas que contiene el pensamiento de Marcuse sobre el pensamiento existencial de Sartre y su superación. (shrink)

Argentine historiography in general, and the history of the Argentine Left in particular, does not receive the attention it deserves in the Anglo-Saxon academic world, due to linguistic and cultural barriers. In this article, we attempt to review for the English-reading public three recent contributions to the history of Marxism in Argentina (Horacio Tarcus's Marx en la Argentina: Sus primeros lectores obreros, intelectuales y científicos, Hernán Camarero's A la conquista de la clase obrera: Los comunistas y el mundo del (...) trabajo en la Argentina, 1920–1935 and Osvaldo Coggiola's Historia del trotskismo en Argentina y América Latina) covering the entire historical spectrum from the early history of Argentine socialism to the history of the PCA and, finally, to the history of local Trotskyism. We attempt to place these works in the context of Argentine historiography and of the political context in which those books were written. (shrink)
